Effective Implementation of Intellectual Property Rights and Rice Trademark Protection

Developing rice trademarks not only contributes to increasing the value of agricultural products but also enhances consumer recognition. Currently, shopping trends have shifted significantly: instead of purchasing bulk rice at stores, people increasingly prioritize pre-packaged rice with reputable brands and transparent information. Consequently, businesses are paying greater attention to registering and establishing intellectual property rights.

According to Mr. Nguyen Van Bay, Deputy Director of the Intellectual Property Office (Ministry of Science and Technology), statistics show that there are approximately 300,000 protected trademarks in Vietnam, with the agricultural sector accounting for only about 16%. Furthermore, the situation of counterfeit goods and imitation brands remains complex. A typical example is the ST25 rice brand of Ho Quang Tri Private Enterprise, where many suppliers have emerged without clarity on variety and trademark ownership, with some even mixing inferior products into packaging bearing the famous brand name.

Mr. Bay emphasized that intellectual property rights infringement goes beyond trade issues; it also hinders plant variety protection. Farmers' habits of retaining seeds for subsequent seasons can lead to variety degradation, while registering trademarks in international markets like the EU, the US, or Australia requires stringent legal standards. A trademark protected only in Vietnam cannot prevent other parties from using it illegally abroad unless registration is secured in that specific nation.

To address these challenges, businesses and farmers must raise their awareness of intellectual property law. Concurrently, authorities must be more decisive in handling violations to ensure a healthy competitive environment. Effectively enforcing plant variety and trademark protection does not only stimulate innovation but also serves as a key legal instrument to affirm the branding of Vietnamese agricultural products on the international stage.
